Howard R. Behar is the principal of The Behar Law Firm, P.A. Mr. Behar founded the firm in 2002‚ following his seven years as an attorney with the business litigation practice group of Rasco‚ Klock‚ Reininger‚ Perez‚ Esquenazi‚ Vigil & Nieto‚ P.L.

Throughout Mr. Behar’s 15 years of practicing law‚ he has represented business entities of all types and sizes in matters involving various legal issues. Consequently‚ Mr. Behar has extensive experience in several substantive law areas‚ especially banking and real estate contract disputes‚ as well as commercial foreclosures‚ UCC-related matters‚ negotiable instruments‚ real estate disputes‚ securities litigation‚ securities fraud and securities arbitration‚ real estate‚ insurance‚ environmental‚ corporate law‚ civil rights/employment discrimination and receiverships. As a seasoned trial attorney‚ Mr. Behar has substantial experience in all levels of litigation‚ and in representing both plaintiffs and defendants.

Mr. Behar is a member of the Florida Bar‚ and is also admitted to appear before several intermediate federal courts‚ bankruptcy courts‚ the Florida Supreme Court‚ and the United States Supreme Court. Mr. Behar has extensive experience in the trial and appellate courts‚ as well as the administrative law process.

Mr. Behar has represented investors before the N.A.S.D. and F.I.N.R.A.‚ the Financial Industry Regulatory Authority in a wide variety of matters including claims against several of the largest national securities brokers for:

  • Theft
  • Churning
  • Variable Annuity and Insurance Sales Practices Fraud
  • Fraudulent bond transactions including high-yield bonds‚
  • Suitability
  • Private placements

In addition to Mr. Behar’s achievements as a practicing attorney‚ he has also made substantial contributions to the legal community. For instance‚ Mr. Behar published an article‚ “Stockbroker Fraud in Florida‚” for the National Business Institute. He has also lectured for the Florida Bar’s Continuing Legal Education program in the area of Securities Fraud and for the National Business Institute in the area of Securities Arbitration. Further‚ Mr. Behar undertook the pro bono representation of visually impaired people‚ for which he received public notoriety and praise‚ and from which he developed substantial experience in the laws pertaining to the Americans with Disabilities Act.

Mr. Behar has been actively involved in the local South Florida community. Specifically‚ he served as Vice Chairman of the Planning and Zoning Board for the City of Surfside. In that position‚ Mr. Behar was active in drafting the City’s zoning code. He was also a member of the Design Review Committee for the City of Surfside.

Mr. Behar received his B.S./B.A. in Economics from the University of Florida Warrington College of Business Administration and his Juris Doctor from Stetson Law School‚ where he served as both the Articles and Symposia Editor for the Stetson Law Review and was active in moot court and trial advocacy. During law school‚ Mr. Behar clerked for the Honorable Susan C. Bucklew‚ a United States District Judge for the Middle District of Florida.
